1. About These Terms

These Terms of Service ("Terms") govern your use of the EverSaid transcription platform ("Service") available at eversaid.ai, operated by Gašper Merela, Ljubljana, Slovenia ("we", "us", "our").

By using the Service - including uploading audio files in demo mode or registering for pilot access - you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

EverSaid provides AI-powered audio transcription, transcript cleanup, and analysis. You can upload audio for transcription and cleanup, or upload a text file (or paste text) for cleanup only. The Service is available in two modes:

  • Demo mode: Available without registration. Subject to usage limits. Audio and transcripts are stored for 30 days, then automatically deleted.
  • Pilot mode: Available to approved early-access users. Requires registration with an email address. Extended limits and no automatic expiration.

The Service is currently provided free of charge during the early-access period. We reserve the right to introduce paid plans in the future with reasonable advance notice.

3. Your Account (Pilot Mode)

If you register for pilot access, you are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must provide a valid email address and accurate information. You must notify us promptly at [email protected] if you become aware of any unauthorized use of your account.

4. Acceptable Use

You agree to use the Service only for lawful purposes. You must not:

  • Upload content that you do not have the legal right to process
  • Upload recordings of individuals without an appropriate legal basis (such as their consent or another lawful ground)
  • Upload content that is illegal, defamatory, or that infringes the rights of any third party
  • Attempt to gain unauthorized access to the Service, other user accounts, or our systems
  • Use the Service to develop a competing product or to systematically extract data
  • Interfere with or disrupt the Service or its infrastructure
  • Use the Service in any way that violates applicable laws or regulations

We may suspend or terminate your access if we reasonably believe you are violating these Terms.

5. Your Content

5.1 Ownership

You retain all rights to the audio files you upload and the content within them. We do not claim ownership of your content.

5.2 License to Us

By uploading audio, uploading text files, or pasting text into EverSaid, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing the Service (transcription, cleanup, and analysis). This license terminates when your content is deleted from our systems.

5.3 Your Responsibilities

You are solely responsible for:

  • The content of your audio recordings and text entries, and any personal data of third parties contained within them
  • Ensuring you have the legal right to upload and process the recordings, including compliance with applicable data protection laws (such as GDPR)
  • Informing individuals whose voices or personal data appear in your recordings about the processing, as required by applicable law
  • Obtaining any necessary consents or establishing another lawful basis before uploading recordings containing personal data of others

We process your content as a data processor acting on your instructions. We do not monitor, review, or assess the content of your recordings. For further details on data processing, see our Privacy Policy at /en/privacy.

6. Intellectual Property

The Service, including its design, software, features, and documentation, is owned by us and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, branding, or proprietary technology.

7. Third-Party Services

EverSaid relies on third-party services for transcription and text processing (listed in our sub-processor list at /en/sub-processors). Your use of the Service is also subject to the terms and policies of these providers to the extent that they process your data. We are not responsible for the actions or failures of third-party services beyond our contractual agreements with them.

8. Service Availability and Changes

The Service is provided on an "as available" basis. We do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue the Service (or any part of it) at any time. For significant changes that affect your stored data, we will provide reasonable notice to pilot users via email.

9. Disclaimer of Warranties

To the maximum extent permitted by applicable law:

  • The Service is provided "as is" and "as available" without warranties of any kind, express or implied.
  • We do not warrant that transcriptions or AI cleanup will be accurate, complete, or error-free.
  • You are responsible for reviewing and verifying all transcripts before relying on them for any purpose, including professional, legal, medical, or academic use.
  • AI-generated output may contain errors, omissions, or inaccuracies. The side-by-side diff view is provided to help you identify changes, but it does not guarantee correctness.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Our total liability to you for any claims arising from or related to the Service is limited to the amount you have paid us in the 12 months preceding the claim (which, during the free early-access period, is zero).
  • We are not liable for any indirect, incidental, consequential, or special damages, including loss of data, loss of revenue, or loss of business opportunities.
  • We are not liable for any damages arising from your reliance on transcription accuracy without independent verification.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or willful misconduct.

11. Data Protection

We process personal data in accordance with our Privacy Policy at /en/privacy and applicable data protection laws, including the GDPR.

Where you upload audio recordings containing personal data of third parties, you act as the data controller for that content, and we act as the data processor processing it on your behalf. The terms of this processing relationship are described in our Privacy Policy.

12. Termination

By you: You may stop using the Service at any time. You can delete your audio and transcripts through the interface. In pilot mode, you can also request full account deletion by emailing [email protected].

By us: We may suspend or terminate your access at any time if you violate these Terms, or if we discontinue the Service. We will provide reasonable notice where possible.

Effect of termination: Upon termination, your license to use the Service ends. In pilot mode, we will delete your account data within 30 days of your deletion request, subject to any legal retention obligations.

13. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Slovenia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Ljubljana, Slovenia.

If you are a consumer within the EU, nothing in these Terms affects your mandatory consumer protection rights under the laws of your country of residence.

14. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. For significant changes, we will notify pilot users by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
